The Foreclosure Process

Texas is a non-judicial foreclosure state, meaning that your lender does not need to take you to court to foreclose on your home. As part of the foreclosure you lender can have your home auctioned  without your consent and you will receive no proceeds from the sale. Your lender is required by law to notify you by mail on two occasions.  If your mortgage balance is not completely paid to be current following these notifications your lender will complete the foreclose proceedings As a result of foreclosure your home will be auctioned to the highest bidder. Within a month following auction if you have not vacated your home the lender will coordinate with law officials to physically remove any persons or possessions in the home and place them on the front curb of the home.
